Enclosure No.2.
14
ATTORNEY GENERAL'S CHAMBERS,
Hong Kong, ..78th. April,.......193 5.
REPORT ON ORDINANCE No. ......19...of 1935 .
1. I have examined the accompanying Ordinance intituled an
Ordinance to amend the Magistrates Ordinance, 1932, and I
am of opinion that the Ordinance is one which is not con-
trary to the Governor's instructions.
2. The object of this Ordinance is to provide a cheap,
simple and direct method of appeal from a magistrate's
conviction or sentence to a judge of the Supreme Court.
3. Section 2 provides an alternative appeal procedure
in such cases by adding new sections, 118A to I, to the
principal Ordinance, without disturbing in any way the
general right of appeal to the Full Court under sections
100 to 117 of that Ordinance.
4. Section 3 adds new forms, 91 and 92, to the First
Schedule to the principal Ordinance.
5. The sources of the new provisions are set out in
the attached Table of Correspondence.
6.
In my opinion this is an Ordinance to which His
Excellency the Governor may properly assent in the name
of His Majesty and on His behalf.
